Development Agreements
A development agreement is a contract between the
developer and the city that governs the relationship of
the two parties with respect to the development
process. Typically these agreements establish the
regulatory standards that will govern the development
of the master-planned community and limit the city’s
ability to alter those regulations during the term of the
agreement. Issues commonly addressed in
development agreements include: the provision of
utility service, the construction and maintenance of
public infrastructure; annexation; and building and land
use regulations.
